WAF.bz is an app for networking with people in the Auto & Mobility Industry. It is owned and run by WAF Garage Ventures Pvt Ltd, hereinafter referred to here as WAF

Please do not sign up and use it if you don't have any interest in these industry domains.

Please be cordial and polite to the fellow members.

Please do not post, share, upload important and private documents, videos, pics and files here which can be misappropriated.

You agree to keep strong passwords with upper and lower case and special characters.

Please don’t upload, download or share content unless you have the right to do so.

We aren’t responsible for the content people post and share at WAF.bz

Don’t share your account credentials or give others access to your account.

You may use WAF.bz only as permitted by applicable law, including export control laws and regulations. Finally, to use WAF.bz, you must be at least 13 years old (or older, depending on where you live).

Data Privacy

Your data belongs to you. We would not share with any third party.

We cannot guarantee 100% Safety against data theft and In case it happens, we shall take measures to protect further damage and also take legal recourse against the perpetrators from the moment we get to know.

You give us permission to read your content and run ads to serve you. Please do not post or upload any content you want to keep private.

Policy on Spamming and posting objectionable content

If you do not have interest in Automotive and Mobility Industry, you may not belong here.

If you spam others or post objectionable content then you can be removed and your membership cancelled. You shall get two warnings before your removal.

and when that happens, your membership amount ( if paid by you ) shall be refunded to you on a pro rata basis.

Reasons for removal and cancellation of Your Membership after two warnings due to following acts :

1. Indulging, posting, abetting objectionable posts and comments

2. trolling any person or mocking and making fun

3. If your posts get reported more than 3 times

Users to report Spam and Objectionable Post

A post can be objectionable if it pertains to :

1. Rumours and False information

2. bullying

3. hurting religious sentiments

4. defaming , spreading hate

5. any thing not permitted by law

The post can be reported by clicking on the drop down menu and selecting report post. It shall be the responsibility of the users to report the posts.

WAF cannot be held liable or be impleaded in any legal matter or any kind of damages for objectionable posts.

WAF can be held liable only if you don't hear from us within 24 hours of you reporting a post or any content which has to be compulsorily followed by sending an email with subject line Objectionable Content to anuj@waf.bz with the reported post link / Content and screenshot.

Notwithstanding the 2 warnings, WAF can also suo moto put your account on hold, terminate it or delete your objectionable post immediately in the interest of upholding law, good conscience, maintaining equity, harmony and peace.

Our Stuff

The Services are protected by copyright, trademark, and other Indian and foreign laws. These Terms don’t grant you any right, title or interest in the Services, others’ content in the Services, WAF trademarks, logos and other brand features. We welcome feedback but please note that we may use comments or suggestions without any obligation to you.

Resolving Disputes

Let’s try to sort things out first.We want to address your concerns without needing a formal legal case. Before filing a claim against WAF, you agree to try to resolve the dispute informally by contacting via contact us option on website or hi@waf.bz and anuj@waf.bz. We’ll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 15 days of submission, you or WAF may bring a formal proceeding.

JudicialForum for Disputes. You and WAF agree that any judicial proceeding to resolve claims relating to these Terms or the Services will be brought in the High Court or District Court of New Delhi, India, subject to the mandatory arbitration provisions below. Both you and WAF consent to venue and personal jurisdiction of such courts in New Delhi and nowhere else due to any circumstance whatsoever.

NO CLASS ACTIONS. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated or representative action. Class arbitrations, class actions, private attorney general actions and consolidation with other arbitrations aren’t allowed. If this specific paragraph is held unenforceable, the entirety of this 'Mandatory arbitration provisions' section will be deemed void.

Controlling Law

These Terms will be governed by law of Union of India except for its conflicts of laws principles.

Entire Agreement

These Terms constitute the entire agreement between you and WAF with respect to the subject matter of these Terms, and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third-party beneficiary rights.

Waiver, Severability & Assignment

WAF's failure to enforce a provision is not a waiver of its right to do so later. If a provision is found to be unenforceable, the remaining provisions of the Terms will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. WAF.bz may assign its rights to any of its affiliates or subsidiaries, or to any successor in the interest of any business associated with the Services.

Modifications

We may revise these Terms from time to time to better reflect:

(a) changes to the law,

(b) new regulatory requirements, or

(c) improvements or enhancements made to our Services.

(d) Fix an inadvertent typo or error.

If an update affects your use of the Services or your legal rights as a user of our Services, we’ll notify you prior to the update's effective date by sending an email to the email address associated with your account or via an in-product notification. These updated terms will be effective no less than 15 days from when we notify you.

If you don’t agree to the updates we make, please cancel your account before they become effective. Where applicable, we’ll offer you a pro rata refund based on the amounts you have prepaid for Services and your account cancellation date. By continuing to use or access the Services after the updates come into effect, you agree to be bound by the revised Terms

Discontinuation of Services

We may decide to discontinue the Services in response to unforeseen circumstances beyond WAF.bz's control or to comply with a legal requirement. If we do so, we’ll give you reasonable prior notice so that you can export Your Stuff from our systems. If we discontinue the Services in this way before the end of any fixed or minimum term you have paid us for, we’ll refund the portion of the fees you have pre-paid but haven't received Services for.

Services “AS IS”

We strive to provide great Services, but there are certain things that we can't guarantee. TO THE FULLEST EXTENT PERMITTED BY LAW, WAF.bz AND ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. THE SERVICES ARE PROVIDED "AS IS". WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some places don’t allow the disclaimers in this paragraph, so they may not apply to you.

Limitation of Liability

WE DON’T EXCLUDE OR LIMIT OUR LIABILITY TO YOU WHERE IT WOULD BE ILLEGAL TO DO SO – THIS INCLUDES ANY LIABILITY FOR WAF.bz's OR ITS AFFILIATES’ FRAUD OR FRAUDULENT MISREPRESENTATION IN PROVIDING THE SERVICES. IN COUNTRIES WHERE THE FOLLOWING TYPES OF EXCLUSION AREN’T ALLOWED, WE'RE RESPONSIBLE TO YOU ONLY FOR LOSSES AND DAMAGES THAT ARE A REASONABLY FORESEEABLE RESULT OF OUR FAILURE TO USE REASONABLE CARE AND SKILL OR OUR BREACH OF OUR CONTRACT WITH YOU. THIS PARAGRAPH DOESN’T AFFECT CONSUMER RIGHTS THAT CAN'T BE WAIVED OR LIMITED BY ANY CONTRACT OR AGREEMENT.

IN COUNTRIES WHERE EXCLUSIONS OR LIMITATIONS OF LIABILITY ARE ALLOWED, WAF.bz, ITS AFFILIATES, SUPPLIERS OR DISTRIBUTORS WON’T BE LIABLE FOR:

i. ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR

ii. ANY LOSS OF USE, DATA, BUSINESS OR PROFITS, REGARDLESS OF LEGAL THEORY.

THESE EXCLUSIONS OR LIMITATIONS WILL APPLY REGARDLESS OF WHETHER OR NOT WAF.bz OR ANY OF ITS AFFILIATES HAVE BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU USE THE SERVICES FOR ANY COMMERCIAL, BUSINESS OR RE-SALE PURPOSE, WAF.bz, ITS AFFILIATES, SUPPLIERS OR DISTRIBUTORS WILL HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITY. WAF.bz AND ITS AFFILIATES AREN’T RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USERS OF THE SERVICES.

WAF IS TAKING SERVICES OF A WELL TRUSTED THIRD PARTY IT SERVICE PROVIDER TO CREATE, RUN, MANAGE AND SUPPORT WAF.BZ. THEY HAVE ACCESS TO ALL WAF.BZ DATABASES AND USER DATA. WAF CANNOT 100% GUARANTEE THE PERFORMANCE OF THEIR EMPLOYEES AND VENDORS WHEN IT COMES TO DATA PRIVACY. WAF SHALL NOT BE LIABLE DIRECTLY OR VICARIOUSLY FOR ANY CLAIM RESULTING FROM OMISSION OF DUTY AND NEGLIGENCE OF ITS THIRD PARTY IT SERVICE PROVIDER.

OTHER THAN FOR THE TYPES OF LIABILITY WE CANNOT LIMIT BY LAW (AS DESCRIBED IN THIS SECTION), WE LIMIT OUR LIABILITY TO YOU TO THE GREATER OF INR 5,000 OR 100% OF ANY AMOUNT YOU'VE PAID UNDER YOUR CURRENT SERVICE PLAN WITH WAF.bz

Paid Accounts

Billing. You can upgrade your account (turning your account into a "WAF Pro Account"). We’ll automatically bill you from the date you convert to a Paid Account and on each periodic renewal date until cancellation. If you’re on an annual plan, we’ll send you a notice email reminding you that your plan is about to be renewed within a reasonable period of time prior to the renewal date. You’re responsible for all applicable taxes, and we’ll charge tax when required to do so. Some countries have mandatory local laws regarding your cancellation rights, and this paragraph doesn’t override these laws.

No refunds. You can cancel your WAF.bz Account at any time. The Paid accounts are Non refundable and there are no Refunds issued. The Only exception is if it was bought by mistake and you need to inform us within 7 days of buying and there shouldn't be any usage during that tenure. After 7 days would require you giving a valid reason of mistake with evidence to our customer care email id hi@waf.bz and anuj@waf.bz

Changes. We may change the fees in effect but will give you advance notice of these changes via a message to the email address associated with your account.
